1. About these terms

This website, kameelandsteel.com ("Site"), and the Kameel and Steel online shop are operated by Kameelandsteel.com ("Kameel and Steel", "we", "us", or "our"), an unincorporated business based in the Isle of Man.

These Terms of Service ("Terms") govern your access to and use of the Site and the purchase of products through it. By using the Site or placing an order, you confirm that you accept these Terms. If you do not agree, you must not use the Site.

2. Changes to these terms and the Site

We may revise these Terms at any time by updating this page. The "Last updated" date shows when they were last revised, and your continued use of the Site means you accept the revised Terms. We may also change, suspend, withdraw, or restrict all or part of the Site without notice and without liability.

3. Accessing the Site

We do not guarantee that the Site, or any content on it, will always be available, uninterrupted, or error-free, and we may suspend, withdraw, or restrict availability for business or operational reasons. You are responsible for arranging your own access to the Site and for ensuring that anyone accessing it through your connection is aware of these Terms.

4. Acceptable use

You agree not to:

  • use the Site in any unlawful or fraudulent way, or for any harmful purpose;
  • attempt to gain unauthorised access to the Site, its servers, or any connected systems or networks;
  • interfere with, damage, or disrupt the Site, including by introducing viruses or malicious code;
  • scrape, harvest, or systematically extract data from the Site without our consent; or
  • misuse our contact channels to send spam, malware, or unlawful or abusive content.

You must also comply with our Acceptable Use Policy. We may suspend or terminate your access if we reasonably believe you have breached these Terms or that policy.

5. Intellectual property

Unless otherwise stated, all content, branding, logos, design, text, graphics, and product imagery on the Site are owned by or licensed to Kameel and Steel and are protected by intellectual property laws. You may view and print content for your own personal, non-commercial reference. You may not otherwise copy, reproduce, distribute, modify, or exploit any content without our prior written permission.

6. Products, pricing and orders

  • Descriptions and images are provided to give a fair impression of the products; natural products such as firewood and charcoal vary in size, colour, and appearance.
  • Prices are shown on the product pages and may change from time to time. We take care to price products correctly, but if we discover an obvious pricing error we may cancel the affected order and refund any amount paid.
  • Availability is not guaranteed; products are subject to stock.
  • Order acceptance β€” your order is an offer to buy. A contract is formed only when we confirm acceptance of your order or dispatch the goods. We may decline or cancel an order (for example, due to stock, pricing errors, or suspected fraud) and will refund any payment taken.

7. Payments

Payments are processed by Paddle (Paddle.com Market Limited and its affiliates). Paddle acts as the Merchant of Record, which means Paddle is responsible for the payment transaction, billing, currency handling, fraud screening, and the calculation, collection, and remittance of any applicable sales taxes or VAT. When you make a purchase you also agree to Paddle's Buyer Terms. Your card and payment details are provided directly to and processed by Paddle; we do not receive or store your full payment card details. Receipts are issued by Paddle, and refunds are handled in line with our Refund & Cancellation Policy and Paddle's terms.

8. Delivery

We deliver within the areas shown at checkout (delivery is available island-wide on the Isle of Man). Delivery timescales are estimates. Risk in the goods passes to you on delivery. Where a delivery cannot be completed for reasons within your control, we may arrange redelivery or charge reasonable additional costs.

9. Third-party links and content

The Site may contain links to third-party websites or resources, provided for convenience only and without endorsement. We have no control over, and accept no responsibility for, the content or practices of any third-party site.

10. Disclaimers

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available", and we exclude all representations, warranties, conditions, and terms (whether express or implied) that might otherwise apply, except that nothing in these Terms affects your statutory rights as a consumer in relation to products you purchase.

11. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your statutory rights as a consumer.

Subject to the above, to the fullest extent permitted by law we will not be liable for any indirect or consequential loss, or for loss of profits, revenue, business, goodwill, data, or anticipated savings, arising out of or in connection with the use of, or inability to use, the Site.

12. Safe use of products

Braais, firewood, charcoal, fire-lighting products, and related accessories must be used responsibly and in line with any instructions and applicable safety guidance. You are responsible for using these products safely, in a suitable location, and keeping children and animals at a safe distance from fire and hot surfaces.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we handle personal data.

14. Severability and waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of it.

15. Entire agreement and third-party rights

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and us regarding your use of the Site. A person who is not a party to these Terms has no rights to enforce them, including under the Contracts (Rights of Third Parties) Act 2001 (Isle of Man).

16. Governing law and jurisdiction

These Terms, their subject matter, and their formation are governed by the law of the Isle of Man. You and we agree that the courts of the Isle of Man will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site, except that this does not deprive you of any protection available to you under the mandatory consumer law of your place of residence.
